Yes, but portable outdoor fireplaces must be utilized following the manufacturer's guidelines and should not be used within 15 feet of any building, flammable materials, or property boundary. Please note that open burning of trash is specifically prohibited in Baltimore City.
Is a Permit Required to have a Fire Pit in Baltimore City?
No a permit is not required, provided all other applicable codes are being followed.
What are the Laws Regarding Grilles in Baltimore City?
Open-flame cooking devices. Charcoal burners and other open-flame cooking devices may not be operated on combustible balconies or within 10 feet (3048 mm) of any combustible construction or property line.
Exception: In the case of a one- or two-family dwelling where the property lines are within a distance of less than 10 feet from the building, it is permissible to use an open-flame cooking device provided that:
1. the device is positioned no less than 6 feet away from any flammable structure; and
2. the appropriate fire extinguishing equipment is readily available:
a. for an LPG burner, a portable fire extinguisher with a minimum rating of 2A-10BC;
b. for a charcoal or wood burner, either:
i. a water fire extinguisher; or
ii. a 5-gallon bucket of water.
